Request for Comments
The LTAMS Legislative Committee highly values feedback from the real property and land title industry in the development of its legislative program. Dedicated comment periods are one of the several ways that LTAMS solicits feedback from stakeholders.
The Process
Request for Comments (RFC) periods are avenues for LTAMS stakeholders to provide feedback on our legislative program. This feedback plays a critical role in the ongoing maintenance and development of resources for the real property and land title industry in Mississippi. All comments will be available for viewing by those who participated in that RFC.

RFC: Title Examination Standards
The Title Examination Standards Board will begin its periodic review of the Standards and statutory and case law changes to determine what, if any, updates, additions, or modifications may be necessary. During this period of review, all Real Property Section Members are encouraged to participate by submitting comments and suggested changes to the Board no later than March 31, 2023 using the following online survey:
You may submit comments on up to 3 standards at a time and may complete the survey as many times as is necessary in order to submit all of your comments. The survey will close automatically at 5PM on March 31st, so please make sure all of your comments are submitted before the deadline. While the primary focus will be looking for changes made necessary due to changes in the law since the standards were published, all comments – including those requesting corrections, modifications, and proposals for new standards – are welcome and will be considered by the Board.
RFC: MS Title Insurance Act
In an effort to ensure that all Association members and the public at large have the opportunity to comment on the proposed Mississippi Title Insurance Act, we are reopening our Requests for Comment (“RFCs”). While there is no deadline to respond, this RFC is currently expected to close no later than June 1, 2022.

The LTAMS Board approved the formation of a Special Committee to review and draft a proposed “Mississippi Title Insurance Act” on January 31, 2020 (last year). Since then, the special committee has been hard at work over the past year doing just that and has now wrapped up Phase 2 of the project. The special committee has decided to Phase 3 of this project and has requested that its current draft be made available for “public comment” through a request for comment (RFC) to be shared with the public and market participants.

RFC: Title Examination Standards
It has now been roughly 18 months since the Mississippi Title Examination Standards went into effect. The Standards were well received and by all accounts have become widely adopted. As is often the case, there have been a few minor changes in the law since the Standards were adopted. As such, the Title Examination Standards Board will begin its periodic review of the Standards and statutory and case law changes to determine what, if any, updates, additions, or modifications may be necessary. RFC: Title Examination Standards
The Title Standards Board (the “Board”) of the Real Property Section of The Mississippi Bar (the “Section”) seeks comments from members of the Section on Chapters 1 – 20 of the proposed Title Examination Standards (the “Standards”). The Standards – when finalized – will be recommended for adoption by the Section at the Section’s annual meeting on July 12, 2019, at the Mississippi Bar convention. A draft copy of Chapters 1 – 20 of the proposed Title Examination Standards are available for download here. Comments must be filed with the Board by emailing the Board’s Chair – Kenneth Farmer at kfarmer@firstam.com – or by using the web form available via the Land Title Association of Mississippi’s Request for Comments page (SURVEY NOW CLOSED). The filing deadline for comments on the initial thirteen chapters of the proposed Standards is May 1, 2019. All comments are welcome and will be taken into consideration by the Board if submitted by the deadline. When submitting your comments, please ensure that you identify the standard (or corresponding comment or caution) that is the subject of your comment and that when the basis of your comment is statutory or case law that you provide references to the same for the Board to consider.
